The Senate Judiciary Committee holds a hearing this afternoon at 3:00 on the nomination of state Judges Albert Diaz and James A. Wynn Jr. to be United States Circuit Judges for the Fourth Circuit. This hearing should give us the first public reaction of Senator Lindsey Graham to the nomination of North Carolina's Diaz to fill the seat of retired Judge William W. Wilkins of South Carolina--assuming Graham shows up, which he hasn't been doing consistently--and give us a clue about whether President Obama consulted with South Carolina's senators before "taking away" one of that state's seats on the court.
